Commissioners' Meeting Minutes - Week of October 14, 2024

Tuesday, October 15, 2024, at 9:00 a.m., Commissioners met in regular session with Chairman Tim Bertling, Commissioner Wally Cossairt, Commissioner Ben Robertson, Clerk Glenda Poston and Deputy Clerk Stephanie Sims.

Commissioners said the Pledge of Allegiance.

Commissioners reviewed claims for payment. Fund totals are as follows:

Commissioner Cossairt moved to sign Certificates of Residency for Heather Cobb. Commissioner Robertson seconded. Motion passed unanimously.

Commissioner Robertson moved to sign LTGP Annual Report. Commissioner Cossairt seconded. Motion passed unanimously.

Commissioners considered the county’s alcohol beverage license application for the Hands Hidden Haven LLC dba Heart Rocks Wine/Hidden Haven Sweets & Treats to sell bottled, canned and tap beer and wine to be consumed on premises. Present were: Chairman Tim Bertling, Commissioner Wally Cossairt, Commissioner Ben Robertson, and Deputy Clerk Stephanie Sims. The proceedings were recorded.

The completed county application has been received as well as the applicable fee. Documentation for the 2024 State of Idaho Retail Alcohol Beverage License, the 2024 City of Bonners Ferry Business License and the 2024 Panhandle Health District Food Permit were also submitted.

Commissioner Cossairt moved to approve the 2024 County Alcohol Beverage License for the Hands Hidden Haven LLC dba Heart Rocks Wine/Hidden Haven Sweets & Treats to sell bottled and canned beer and wine to be consumed on and off premises. Commissioner Robertson second. Motion passed unanimously.

The meeting to consider the county alcohol beverage license ended at 9:42 p.m.

Commissioner Cossairt moved to sign Resolution 2024-54 Increasing the Justice Fund Sheriff Budget Due to Receipt of Unanticipated Revenue. Commissioner Robertson seconded. Motion passed unanimously.

RESOLUTION 2024-54

INCREASING THE JUSTICE FUND SHERIFF BUDGET
DUE TO RECEIPT OF UNANTICIPATED REVENUE

WHEREAS, the Board of County Commissioners, County of Boundary, State of Idaho, did establish an operating budget for the Boundary County Justice Fund Sheriff Budget for fiscal year 2023-2024, and

WHEREAS, Boundary County has received reimbursement in the amount of $49,892.96 from the State of Idaho, 2021 Operation Stonegarden Grant for reimbursement for the following needs, and

WHEREAS, the Boundary County Justice Fund Sheriff Budget is in need of additional revenue for fiscal year 2023-2024, and

WHEREAS, the addition of this revenue does not affect the tax levy for Boundary County, and

WHEREAS, it is appropriate to increase the Boundary County Justice Fund as follows:

NOW THEREFORE, upon motion duly made, seconded and unanimously carried,

IT IS RESOLVED, that the increase to the Boundary County Justice Fund Revenue Account Numbers and the Boundary County Justice Fund Sheriff Budget Expense Account Numbers as outlined above is hereby authorized and ordered, and

IT IS FURTHER RESOLVED that the Clerk is instructed to deliver certified copies of this resolution to the Boundary County Treasurer and the Boundary County Auditor.

9:53 a.m. Ron and Shawn Frederickson with Frederickson’s Garbage and Solid Waste Superintendent, Richard Jenkins joined the meeting.

Chairman Bertling stated that they were here to discuss holiday schedule for garbage.

Shawn Frederickson stated that they do work on Thanksgiving, do not work on Christmas, occasionally on New Years depending on the day of the week it falls on. The holidays that fall on Monday are the issue. There was a brief discussion on what those holidays were. Chairman Bertling figured there were 5 holidays that land on Monday.

Solid Waste Superintendent Richard Jenkins, would like to have staff at the landfill on the holidays to cover the garbage that is brought in by the trucks. Chairman Bertling asked if Frederickson’s would cover two employees at the landfill on those days.

Ron Frederickson questioned about how much would that be. Commissioner Robertson answered it would be roughly $140 per day for two employees.

Ron Frederickson felt that the money paid to the county already should cover this amount.

Commissioner Bertling asked Mr. Jenkins if there were any other alternatives. Mr. Jenkins asked about holding over garbage that can then be brought it in the next day. Ron Frederickson said that is pushing them so that they are then a half day behind and struggling to catch up.

Commissioner Robertson stated that he does not see a way around it. The landfill needs to be open to allow them to dump on those days.

Commissioner Bertling said that with this being 5 days per year, he doesn’t see this as being such a big issue. There needs to be conversation on the other holidays to find a schedule that works.

Commissioner Robertson stated that we need to proceed with this year and look at it again in the future.

Chairman Bertling stated that I understand the garbage needs to be covered. Mr. Jenkins replied that it is regulation that the garbage needs to be covered.

Commissioner Cossairt asked how many city residents recycle. Shawn Frederickson answered about half of them do. Commissioner Cossairt stated that there needs to be some conversations about increasing that number.

10:28 The meeting with Ron and Shawn Frederickson completed and they left the meeting. Commissioner Cossairt left the meeting to attend a funeral.

10:30 Executive session pursuant to Idaho Code 74-206(1)b, to consider the evaluation, dismissal or disciplining of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public school student. Executive session ended at 11:04. No action taken.

11:42 Commissioners recessed for lunch.

1:25 Commissioners reconvened and Commissioner Cossairt rejoined the meeting.

1:28 Adam Ryals with Road and Bridge joined the meeting and discussed projects they are working on throughout the county including sign work, sweeping, grading work, removing brush, paving and organizing items for the auction. Road and Bridge has a pallet of crack sealant that they do not use and will transfer that to maintenance for use on the parking lot at the courthouse. The welder will be set aside as well to possibly give to the high school. Mr. Ryals had also attended LHTAC funding workshop.

There was discussion on paving projects and work that is being done to improve the dips on some of the paved roads around the county. Commissioner Bertling mentioned that the Copeland Bridge has improved.

Commissioner Bertling asked about right of away in regards to fencing along roadways. Mr. Ryals answered that Idaho statutes states all roads have 50 feet of right of way.

Mr. Ryals stated that there are other issues about approach on roads where a culvert was not installed as required. There was discussion on what can be done to enforce people to follow the rules.
Mr. Ryals stated that road standards need to be updated he is working on them with Civil Attorney, Bill Wilson.

Commissioner Bertling asked if approach permits were slowing down. Mr. Ryals felt there were about 8 they are working on with about 5 more coming in the near future.

Mr. Ryals asked about how the Commissioners felt about County trucks going home with foreman on call for the weekend. The foreman is over the pits as well. Commissioner Robertson felt a foreman should have a truck so they can deal with issues when on call. He also asked if there were enough calls to warrant it. Mr. Ryals answered yes, especially during the winter. Commissioner Robertson asked if trucks are returned to the shop when the foreman is on vacation. Mr. Ryals answered, not currently. But that can be changed. The Commissioners agreed that the trucks should be returned during vacations.

Chairman Bertling asked if Road and Bridge was fully staffed. Mr. Ryals answer yes, with 22 employees.

1:52 The meeting with Mr. Ryals ended and he left the meeting.
