***Monday, October 31, 2016, at 9:00 a.m., Commissioners met in regular session with Commissioner LeAlan Pinkerton, Commissioner Walt Kirby, Clerk Glenda Poston, and Deputy Clerk Michelle Rohrwasser. Chairman Dan Dinning was out of the office tending to other matters.

Commissioner Kirby moved to appoint Commissioner Pinkerton Acting Chairman in the absence of Chairman Dinning. Commissioner Pinkerton second. Motion passed unanimously.

Blue Sky Broadcasting News Reporter Mike Brown was in attendance of the meetings off and on throughout the day.

9:00 a.m., Road and Bridge Department Superintendent Clint Kimball joined the meeting to give his departmental report. Mr. Kimball presented a written report.

Mr. Kimball said the Local Highway Technical Assistance Council representative from the state informed him that Road and Bridge could amend its original application for Local Highway Safety Improvement Projects (LHSIP) for the guardrail safety improvement projects and also take in a project on Eileen Road or Deep Creek, or both. Mr. Kimball said he will submit a new application, which will require Commissioners’ signature stating they are in support of the project and in addition, that no right-of-way is required.

Mr. Kimball said he has sought quotes for salt for winter use and has received three quotes. The quote is for two items as follows: Item #1, kiln dried brine salt with less than .05% moisture and Item #2, is sodium chloride road salt with less than 5% moisture. Mr. Kimball briefly explained the salt brine system and added that he will apply granular salt to the steep roads and liquid salt to the flat roads. Mr. Kimball said the quotes are price per ton and Commissioners reviewed the information.

The quotes received are as follows: Doug Andrus Distributing quoted $109 per ton of kiln dried brine salt and $93.65 per ton of sodium chloride road salt.

Roadwise quoted $138 per ton of kiln dried brine salt and $112 per ton for sodium chloride road salt.

Salt Distributors quoted $145 per ton of kiln dried brine salt and $125 per ton for sodium chloride road salt.

All quotes received are for “delivered-freight on board to Bonners Ferry, Idaho.”

Commissioner Kirby moved to accept the quote from Doug Andrus Distributing of $109 per ton for kiln dried brine salt and $93.65 per ton for sodium chloride road salt. Acting Chairman Pinkerton yielded the chair to second. Motion passed unanimously.

Commissioner Kirby moved to sign the Local Highway Safety Improvement Projects application through the Local Highway Technical Assistance Council for projects in addition to the guardrail project, as the documents are time sensitive. Chairman Pinkerton yielded the chair to second. Motion passed unanimously.

Mr. Kimball reviewed his department report. Road and Bridge worked on repairing the slough on Shiloh Loop. Mr. Kimball reported that on Funkhouser Street, water has been leaving the county’s right-of-way and traveling downhill to the golf course, which causes soil to be lost. Mr. Kimball spoke of the remedy used to correct the situation and he added that cooperation with the City of Bonners Ferry on this project has been great.

The Boundary Area Transportation Team (BATT) had their meeting last week combined with the Bonner County Area Transportation Team (BCATT) meeting. Senator Keough and Representative Sage Dixon were invited to speak. Commissioner Kirby said it was a good meeting. Mr. Kimball said he is trying to continue work on the access areas at Pleasant Valley Road. Rock will be placed to raise this area and work will be done to the ditches. Mr. Kimball said the sink hole that reoccurs on Cow Creek Road has been fixed. New yard lights have been put up at the Road and Bridge shop to help get employees going in the morning. Mr. Kimball said road sign work continues and the sand pile was finished in between rain storms.

Mr. Kimball said ¾ inch rock is being hauled to Shiloh Loop and the work to Cow Creek Road will be completed tomorrow if there are no interruptions. Mr. Kimball said he has reports of receiving 7.2 inches of rain so far and 7.4 inches was reported at Elk Mountain Farms. Mr. Kimball said at his home he estimated about one more inch of rain was received last night.

Mr. Kimball said he understands why the county cannot plow private roads, but he would really like Commissioners to think about allowing him to plow snow at the Curley Creek fire station on an emergency basis to keep the area open. It’s about right and wrong and the community. Acting Chairman Pinkerton said we have a moral obligation to take that step for emergency services, even if it is a private road. Commissioners are just waiting to hear the opinion of County Civil Attorney Tevis Hull. Mr. Kimball said there is an issue with how narrow Silver Springs Road is and some of it may actually be on Bonneville Power Administration’s right-of-way. The road is a long way from meeting county specifications, according to Mr. Kimball. Acting Chairman Pinkerton said Commissioners need to hear back from their attorney, but this is community emergency response and it is not as if the county is going to plow this road every day.

Acting Chairman Pinkerton asked Mr. Kimball how the gravel roads are holding up with the amount of rain we are having. Mr. Kimball said roads are not bad and should be okay and he added that he has some “bonier” material he is thinking about applying to the bad areas. Mr. Kimball said he has received two complaints about roads that didn’t warrant complaints if these roads were compared to others as these were just potholes. Mr. Kimball said Road and Bridge is staying on top of grading and he added that even though we have received large amounts of rain, it hasn’t been pounding rain.

The meeting with Mr. Kimball ended at 9:25 a.m.

Deputy Clerk Nancy Ryals joined the meeting.

9:31 a.m., Commissioner Kirby moved to go into closed session pursuant to Idaho Code 31-874. Acting Chairman Pinkerton yielded the chair to second. Motion passed unanimously. 9:33 a.m., Commissioner Kirby moved to go out of closed session. Acting Chairman Pinkerton yielded the chair to second. Motion passed unanimously.

Commissioner Kirby moved to deny indigent applications 2017-1 and 2017-2. Acting Chairman Pinkerton second. Motion passed unanimously.

Commissioners tended to administrative duties.

Commissioner Kirby moved to approve the minutes of October 24 & 25, 2016. Acting Chairman Pinkerton yielded the chair to second. Motion passed unanimously.

10:00 a.m., Dick Staples with JRS Surveying joined the meeting to update Commissioners on the matter of property that had been tax deeded in the 1940’s.

Mr. Staples said he has completed the survey for the tax deeded property located on the north side. Commissioners and Mr. Staples reviewed the survey and Mr. Staples pointed out the water meter and driveways coming through the property. Mr. Staples said he doesn’t know if the water meter is associated with this property and the streets don’t line up with anything. The points are pinned and the county owns lots 4, 5, and 6, less 20 feet of Lot 6. Mr. Staples said he would follow up with a letter of explanation and he informed Commissioners that the mobile home in this vicinity is not located on this property, which had been a concern of his.

The meeting with Mr. Staples ended at 10:04 a.m.

Commissioner Kirby moved to approve and sign the County Annual Juvenile Justice Report to the Idaho Department of Juvenile Corrections for the reporting period of October 1, 2015 to September 30, 2016. Acting Chairman Pinkerton yielded the chair to second. Motion passed unanimously.

Commissioners tended to administrative duties.

There being no further business, the meeting adjourned at 10:21 a.m.
