At 6:00 PM Chairman Caleb Davis identified the presence of a quorum, opened the Meeting, and asked the Commission if there were any changes or corrections to be made to the Minutes of the February 20, 2020 Meeting. There being none, Davis asked for a motion to approve the February 20 Minutes. Ron Self so moved, seconded by John Cranor, and there being no further discussion Davis called for a vote. The votes were as follows:

The motion to approve the February 20, 2020 Meeting minutes was passed.


Chairman Caleb Davis opened the meeting agenda with the application to grant a Variance to Michael Simpfendorfer with regards to placing a garage on his property closer than the setback distance of 25 feet from the southern border of his parcel in an Agriculture Forestry zone.

The Planning and Zoning discussion included:

  1. No suitable location for a garage

  2. Southern neighbor (Fee) not represented

  3. Northern neighbor (Moon) in favor, no objection

  4. Staff Report

    1. Staff read analysis regarding Variance application

    2. Caleb mentioned absence of neighbor - to be addressed?

    3. No objections were made

    4. Ron Self questioned John Poland's dispute with his (Poland's) neighbor's storage container

  5. Wade Purdom made a motion to approve Application 20-055, Tim Heenan seconded the motion.

The motion to approve application 20-055, a request for a variance on setback distance of less than 25 feet in the Agriculture/Forest zoned property was passed unanimously.


Chairman Caleb Davis then took the next item on the agenda, an application to grant a Variance to Kimber Glidden with regards to allowing a distance of less than 20 feet from the southern border of her parcel in a Rural Residential zone.

The Planning and Zoning discussion included:

  1. Reference: Ordinance Section 12.4.5.

  2. Wants to allow setback of 10 feet

  3. After survey, discovered house and deck and trees were not positioned correctly

  4. Peachy's have no access to hay field so she gave Peachy extra land and access off Wheeler Rd

  5. Olivia (mapper) said it did not meet setback requirements

  6. Neighbors are in agreement with each other

  7. Staff Report - Staff read analysis regarding Variance application

  8. Ron Self made a motion to approve Application 20-087, David Hollabaugh seconded the motion.

Davis Called for a vote and the votes were as follows:

The motion to approve application 20-087, a request for a variance on setback distance of less than 20 feet in the Rural Residential zoned property was passed unanimously.


Chairman Caleb Davis then took the next item on the agenda, 20-098, an application to grant a Zone Map amendment to Kelly Jelinek with regards to allowing a zone change on the southern .42 acres (per John Marquette, JRS Surveying) of her parcel in an Agriculture/Forestry zone, changing the zone to Commercial/Light Industrial.

The Planning and Zoning discussion included:

  1. Established Commercial usage

  2. County Commissioners - 1995 - Special Use Permit

  3. Access from Sandy Ridge Rd

  4. Two separate accesses, commercial separate from remaining parcel

  5. Road and Bridge expressed access concern - applicant notified

  6. Staff Report - Special Use in 1995 like Conditional Use today - goes with the land

  7. Wade Purdom made a motion to recommend approval to the County Commissioners of Application 20-098, Ron Self seconded the motion.

Davis Called for a vote and the votes were as follows:

The motion to recommend approval to the County Commissioners of application 20-098, a request to change the zone on the southern .42 acres of parcel RP61N01E317301A in an Agriculture/Forestry zone, changing the zone to Commercial/Light Industrial, was passed unanimously.


Chairman Caleb Davis then took up the last item on the agenda, a review of 19-177, an application submitted by the Planning and Zoning Commission to update selected portions of Ordinance 9B18LOV2. Staff suggested that there was not enough time to do the review justice, but that it could be reviewed in the next regularly scheduled Planning and Zoning meeting, to be held on September 17th 2020. Staff suggested reviewing the comments made by the County Commissioners as per the minutes from a meeting in which the Commissioners examined the proposed changes. All present agreed that delaying this review was acceptable, and no part of application 19-177 was discussed.

Davis thanked everyone for participating in the hearings then asked if there was a motion to adjourn. Wade Purdom so moved, Ron Self seconded, approved unanimously at 7:45 pm and the meeting was adjourned.
