Commissioners' Meeting Minutes - Week of February 24, 2025

***Monday, February 24, 2025 at 9:00 a.m., Commissioners met in regular session with Chairman Ben Robertson, Commissioner Lester Pinkerton, Clerk Glenda Poston and Deputy Clerk Stephanie Sims. Commissioner Bertling was absent.

Commissioners said the Pledge of Allegiance.

Superintendent of BCSD Jan Bayer, Deputy Clerk for Elections Cherry Grainger and resident Fay Almond entered the meeting at 9:00 a.m.

Ms. Bayer stated that she had requested this meeting to educate what the supplemental levy funded. Ms. Bayer stated that it is well known that the state doesn’t fully fund education - the reality is that it funds 60% of the cost. The supplemental levy has been in place to help fill the gaps since the 1980’s. Ms. Bayer stated that the amount of the levy has not increased since 2015, so the school board is doing their best to be fiscally responsible. She reviewed the list of items that the levy funds and amount paid per $1,000 of assessed value.

Greg Lamberty entered the meeting at 9:18 a.m.

Ms. Bayer stated that they will have the wording for the ballot approved at their March 10th meeting and submitted on March 11th to Ms. Grainger.

Chairman Robertson asked how the agriculture program could be affected if the levy does not pass. Ms. Bayer answered two CTE positions would be cut. Ag affects over 100 students, but it would be considered for the cut.

The meeting with Ms. Bayer ended at 9:25 a.m. and she left the meeting. Ms. Grainger also left the meeting.

The meeting with Civil Attorney Bill Wilson was cancelled because he was ill.

Commissioner Pinkerton moved to sign Certificate of Residency for Lilly Perez. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

Commissioner Pinkerton moved to sign Commissioner’s meeting minutes from 2/17. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

Commissioner Pinkerton moved to sign New Private Road Name Request Form for Noel Lane. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

Commissioner Pinkerton moved to sign EDPRO grant #006467 amendment. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

Commissioner Pinkerton moved to sign Request for State Airport Aid Supplemental Funding application. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

Commissioner Pinkerton moved to sign Petroleum Storage Tank Fund Insurance Renewal Application. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

Chairman Robertson stepped down as chair and moved to appoint Jeff Hood, Kevin Merrifield, Erik Olson to 6-year terms and Tom Daniel and Mike Riebli to 4-year terms for the Agriculture Protection Area Board. Commissioner Pinkerton second. Motion passed unanimously.

Commissioner Pinkerton moved to sign letters of appointments to the APA Board. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

Commissioner Pinkerton moved to sign Resolution 2025-15 Authorizing Disposition of Records from the Treasurer’s Office. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

A RESOLUTION AUTHORIZING THE DISPOSITION OF RECORDS
OF BOUNDARY COUNTY TREASURER’S OFFICE

WHEREAS, the Boundary County Treasurer’s Office is currently storing old records of Boundary County; and

WHEREAS, due to lack of storage space, the Boundary County Treasurer’s Office has requested permission to dispose of old records; and

WHEREAS, the Boundary County Prosecuting Attorney’s Office has advised the Board of Boundary County Commissioners regarding the classification of such records pursuant to Idaho Code 31-871; and

NOW THEREFORE, upon motion duly made seconded and unanimously carried,

IT IS HEREBY RESOLVED, that the following records be classified and disposed of as follows:

Commissioner Pinkerton moved to appoint Mike Cossairt to the Waterways Board for a 3-year term ending January 2028. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

Fay Almond and Greg Lamberty left the meeting at 10:20 a.m.

Commissioners attended to administrative duties until 11:45 a.m. when they recessed for lunch.

Commissioners reconvened for the afternoon session at 1:15 p.m. with Chairman Robertson, Commissioner Pinkerton, Clerk Glenda Poston and Deputy Clerk Stephanie Sims.

Louis & Nancy Maggi and Nicole Fitch entered the meeting at 1:20 p.m.

Road & Bridge Co-superintendents Adam Ryals and Brad Barton entered the meeting at 1:28 p.m.

Ms. Fitch stated that their question is in regards to the driveway needing a culvert. She stated that the driveway was put in prior to the Road Standards requiring culverts. The previous Road & Bridge supervisor didn’t say anything about a culvert needing to be placed. Now that a waterline is going in, the driveway has been flagged as needing a culvert. Ms. Fitch stated that no other driveways have culverts.

Chairman Robertson stated that every driveway needs to have a culvert according to our ordinance. Commissioner Pinkerton stated that there are a lot of mitigating circumstances involved in this situation.

Commissioner Robertson requested Road and Bridge to drive it and pull the permits for the other driveways so that we can review all of the information.

The meeting with Mr. & Mrs. Maggi and Ms. Fitch ended left they meeting 1:58 p.m.

Mr. Ryals handed out the Road & Bridge Report and stated that they started closing roads this morning due to spring breakup.

Sheriff Stolley and Restorium Supervisor Jenay Smith entered the meeting at 2:00 p.m.

Commissioner Pinkerton moved to sign Administrative Settlements for Schoolhouse Road Improvements. Chairman Robertson stepped down as chair to second. Motion passed unanimously.

The meeting with Road & Bridge ended at 2:02 p.m. and Mr. Ryals and Mr. Barton left the meeting.

Chairman Robertson moved to go into executive session 74-206(a) to consider hiring a public officer, employee, staff member or individual agent, wherein the respective qualities of individuals are to be evaluated in order to fill a particular vacancy or need. This paragraph does not apply to filling a vacancy in an elective office or deliberations about staffing needs in general. Executive Session 74-206(b) to consider the evaluation, dismissal, or disciplining of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public-school student. Commissioner Pinkerton second. Commissioners voted as followed: Chairman Robertson “aye”, Commissioner Pinkerton “aye”. Motion passed unanimously.

Ms. Smith left the meeting at 2:20 p.m.
Sheriff Stolley left the meeting at 2:48 p.m.

Executive session ended at 2:55 p.m.. No action taken.

Chairman Robertson stepped down as chair and moved to approve the extension of taxes due on parcel #MHM00000168110A in the amount of $245.32. Commissioner Pinkerton second. Motion passed unanimously. Will have paid by April 1, 2025.
